This article is general information, not legal advice. Every situation is different. Talk to an attorney about yours.

Start with the numbers

Compare what you could realistically recover with the likely cost and time of litigation. A strong claim against a party who can’t pay may not be worth pursuing.

Consider leverage and relationships

Sometimes the threat of litigation, backed by a well-prepared case, produces a better settlement than a lawsuit itself. Ongoing business relationships may also favor negotiation.

Know when to move fast

Contract deadlines, notice requirements and statutes of limitation can cut off claims. Talk to counsel early, even if you hope to settle.
